Dealer Loyalty Marketplace – Privacy Policy

Last Updated: March 2026

This Privacy Policy describes how the Dealer Loyalty Marketplace powered by Mediagistic, Inc. (“Mediagistic,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards information through your use of the Dealer Loyalty Marketplace (the “Portal”). The Portal is provided to users who authenticate via single sign‑on (“SSO”) from Daikin North America (or related entities). Please read this Privacy Policy carefully.

1. Information We Collect

We collect and process the following categories of information:

a. Account / Identity Information
You may provide your name, email address, company name, user identifier, role, and other profile data as part of your account. Because login is via SSO, certain identity attributes may be passed from the Brand identity provider to us (for example, your name and email address).

b. Transaction & Order Information
When you purchase products or services via the Portal, we receive order details (for example, product purchased, date, invoice value). Payment credentials are handled by Stripe or the applicable payment processor; we do not store raw credit card numbers. The payment processor may provide transaction confirmation, status, refunds, and metadata for bookkeeping and service delivery.

c. Usage / Analytics Data
We automatically collect usage data such as IP address, browser type, device type, pages visited in the Portal, time stamps, session durations, and similar telemetry data. We may use cookies, local storage, web beacons, or similar tracking technologies to operate the Portal, enhance your experience, and for analytics or performance optimization.

d. Advertising Platform and Service Data (When Applicable)
If you purchase advertising-related services (for example, Google Ads or Meta Ads), we may collect and process information necessary to set up, manage, and report on campaigns, such as campaign identifiers, performance metrics, and account-related information made available through the relevant platforms and tools.

e. Communications
If you contact us (for example, via support), we collect the information you provide. We may record correspondence, support tickets, chat logs, or emails for internal reference, quality assurance, and compliance.

2. Use of Information

We use information for purposes including:

  • To provide, operate, and maintain the Portal.
  • To process orders and facilitate delivery of products and services.
  • To monitor and analyze usage, performance, and trends.
  • To improve, optimize, or personalize aspects of the Portal.
  • To communicate with you (order confirmations, system notices, support responses).
  • To detect, prevent, or address technical issues, fraud, abuse, or security breaches.
  • To enforce our legal rights or comply with legal obligations.
  • In connection with a merger, sale, or transfer of assets (see “Business Transfers” below).

3. Disclosure of Information

We may share information under limited circumstances:

a. Service Providers
We may share data with third‑party vendors, contractors, or agents who perform services on our behalf (for example, analytics providers, hosting, support tools, and email services). These entities are contractually obligated to limit use of data to the purposes we specify and to maintain confidentiality.

b. Advertising Platforms and Tools (When Applicable)
Where you purchase advertising services, information may be shared with advertising platforms, publishers, and related technology providers as necessary to run campaigns, attribute results, and provide reporting.

c. Legal Compliance / Protection
We may disclose information when required by law, court order, subpoena, or lawful request by public authorities. We may also disclose information when we believe in good faith it is necessary to prevent harm, enforce our policies, detect fraud, or protect rights and property.

d. Business Transfers
If Mediagistic (or the Portal business) is sold, merged, or otherwise transferred, we may share or assign your information as part of that transaction. We will attempt to notify you of any such change.

e. Aggregated / De‑identified Data
We may share aggregated or de‑identified usage or performance data that does not identify you for analytics, benchmarking, or similar purposes.

4. Cookies and Tracking

We use cookies and similar tracking technologies (web beacons, pixel tags, local storage) to collect and store information about your interaction with the Portal. Cookies may be session-based or persistent. You may control or disable cookies via your browser settings, but that may limit your ability to use certain functionalities.

5. Security

We implement reasonable administrative, technical, and physical safeguards to help protect personal data. However, no transmission or storage method is absolutely secure; we cannot guarantee absolute security. In case of a data breach, we will comply with applicable legal notification obligations.

6. Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce agreements. After it is no longer needed, we will securely delete or anonymize it.

7. Your Rights (Depending on Jurisdiction)

Depending on your jurisdiction, you may have rights such as access, correction, deletion (subject to legal constraints), restriction, objection to certain processing, and data portability. To exercise these rights, contact us using the details below. We may verify your identity before granting a request.

8. International Transfers

If you are located outside the United States, note that your information may be transferred to, stored, and processed in the United States by us or our service providers. We will take steps to ensure appropriate safeguards are in place, such as contractual protections where applicable.

9. Children’s Privacy

The Portal is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we inadvertently collected data from a child, contact us and we will take steps to delete it.

10. Third‑Party Links

The Portal may contain links to third‑party websites or services. We are not responsible for the privacy practices or content of those sites. We encourage you to read their privacy policies.

We may update this Privacy Policy from time to time. We will post the revised version and update the “Last Updated” date. Significant changes may be communicated via email or notice in the Portal.
